Florida Alimony Reform 2023
As of July 1, 2023, the Florida Alimony Reform bill for 2023, which has been signed by the Governor, is now in effect and applies to all pending or initiated cases.
What You Need To Know
The statute provides more defined rules concerning alimony awards and is now including a formula for the award of durational alimony.
Permanent alimony is removed from the statute, but the court can extend the length of durational alimony under exceptional circumstances if clear and convincing evidence is presented. This will raise the evidentiary burden for the party seeking alimony but adds clear criteria for consideration by the court.
The statute redefines short, moderate, and long-term marriages and places time limits on rehabilitative alimony.
